Welcome to JWL.

These Terms and Conditions govern your use of and purchases through the JWL e-commerce platform. By accessing or using the Platform, placing an order, or purchasing any products, you agree to be bound by these Terms. Please read them carefully.

1. INTRODUCTION

1.1 About JWL

JWL is an online marketplace that collaborates with a curated selection of professional, certified, and highly reputable dealers (“Dealers”) specialising in pre-owned and second-hand jewelry. Our goal is to provide buyers (“you” or “your”) access to high-value jewelry pieces (the “Products”) at competitive prices, facilitated through a secure and transparent platform.

While JWL facilitates transactions, each Product is offered and sold by a third-party Dealer. Dealers are solely responsible for the authenticity and condition of the items they list. JWL does not take ownership of the Products at any point.

1.2 Global Availability

The Platform is available to users globally, subject to compliance with these Terms and any applicable local laws or regulations.

2. ACCEPTANCE OF TERMS

2.1 Binding Agreement

By using the Platform or by placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, as well as any additional guidelines, policies, or disclaimers referenced herein.

2.2 Updates to Terms

We reserve the right to revise or update these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of the Platform after such posting constitutes acceptance of the revised Terms.

3. ELIGIBILITY

3.1 Legal Capacity

You must be at least the age of majority in your jurisdiction (e.g., 18 years old in most countries) and have the legal capacity to enter into binding contracts to use the Platform and purchase Products.

3.2 Accuracy of Information

You agree to provide accurate and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. PRODUCT LISTINGS AND DESCRIPTIONS

4.1 Dealer Responsibility

All Products listed on the Platform are provided by our vetted and certified Dealers. While JWL makes reasonable efforts to ensure accurate listings, the Dealers are ultimately responsible for the accuracy, completeness, and authenticity of the information they provide.

4.2 Pre-Owned Condition

All Products are second-hand or pre-owned. Therefore, minor signs of wear or imperfections may be present. We strive to include detailed photographs and descriptions, including any known defects, to ensure transparency.

4.3 Certification

Where applicable, Products will include relevant certifications (e.g., gemological reports, original documentation) from reputable industry organisations, as provided by the Dealer.

5. ORDERS AND PAYMENTS

5.1 Placing an Order

When you place an order through the Platform, you agree to pay the total amount displayed at checkout, including any applicable taxes, shipping fees, and insurance costs.

5.2 Payment Methods

We accept various payment methods as displayed at checkout. By providing a payment method, you represent and warrant that you are authorised to use it and that the payment information you provide is true and accurate.

5.3 Order Confirmation

After you submit your order, you will receive an order confirmation email. This confirmation is not acceptance of your order but a record of our receipt of it. We reserve the right to cancel or refuse any order at our discretion, for reasons including but not limited to: Product unavailability, inaccuracies, or suspicion of fraudulent activity.

6. CANCELLATIONS

6.1 Free Cancellation Before Dispatch

You may cancel your order at no additional cost before the order is dispatched (i.e., before it leaves the Dealer’s premises for shipment).

6.2 Cancellation After Dispatch

If you wish to cancel your order after it has been dispatched, you will be responsible for all shipping costs incurred up to the point of cancellation, as well as the cost of returning the Product to the Dealer.

You may have the option to purchase additional insurance coverage at checkout to offset these potential cancellation and return costs, depending on the shipping provider and your region.

6.3 How to Cancel

To cancel your order, please contact our Customer Support immediately with your order details. The time and date of your cancellation request will determine if you are eligible for a free cancellation or if additional costs will apply.

7. SHIPPING AND DELIVERY

7.1 Shipping Partners

We use specialized shipping services with premium security, insurance, and storage facilities appropriate for high-value items. These services come at a higher-than-average cost to ensure the protection of the Products.

7.2 Shipping Times and Costs

Shipping times may vary depending on your location. Estimated delivery dates and costs will be provided during checkout. Any delivery date provided is an estimate and not a guarantee.

7.3 Tamper-Proof Seals

All Products are shipped in tamper-proof packaging. If you notice any signs of tampering upon delivery, you must refuse the shipment or note the tampering with the carrier upon receipt, and inform us immediately.

7.4 New/Updated: Multiple Shipping Options

We may offer multiple shipping options (e.g., standard, expedited, or specialised secure courier). It is your responsibility to select the shipping option that best suits your preferences and security requirements. You may also be offered the option to purchase additional insurance (e.g., for cancellation or high-value protection) at checkout.

8. DUTIES, TAXES, AND CUSTOMS

8.1 Variable Regulations

Different countries have different rules regarding duties, taxes (including VAT or GST), customs declarations, and export/import restrictions. Some materials (e.g., certain types of jade) are restricted from import into specific countries.

8.2 Product Restrictions

We make our best efforts to ensure that Products subject to export or import restrictions are not displayed for purchase in regions where they cannot be legally shipped. However, it is ultimately your responsibility to understand the laws and regulations of your own country regarding any restricted materials.

8.3 Tax and Duty Estimates

Where possible, we will integrate local taxes and duties at the point of purchase. If this integration is not possible due to jurisdictional complexities, we will clearly display any additional charges that may apply upon delivery. By completing a purchase, you agree to pay all applicable duties, taxes, and fees as required by your local customs authority or government.

8.4 Additional Costs

If your local customs authority imposes additional charges (duties, brokerage fees, or other taxes) beyond what was estimated or displayed at checkout, you agree to cover those costs. Failure to pay these charges may result in the shipment being held, returned, or destroyed by the customs authority; in such cases, JWL is not responsible for any loss.

9. RETURNS AND REFUNDS

9.1 No Returns Policy

Due to the high value, specialised nature, and vulnerability to fraud (e.g., swapping or replacing parts), we do not accept returns or offer refunds for any reason except in the limited circumstances outlined in Section 9.2.

9.2 Exceptions

Damage in Transit: If a Product arrives clearly damaged from transit, you must notify us immediately and provide sufficient evidence as requested (see Section 10 on video requirements).

Wrong Product Received: If the Product you receive does not match the description of the item you ordered, you must notify us immediately and provide the required evidence (see Section 10).

9.3 Exclusions

No refunds will be granted for reasons such as (but not limited to) change of mind, personal preference, or incorrect sizing. We encourage you to carefully review all Product details, measurements, and photographs before placing an order.

9.4 Compliance with Local Laws

In jurisdictions such as the European Union or the United Kingdom, consumers may have a statutory right to cancel their purchase within a specified period (e.g., 14 days) without needing to provide a reason. Where applicable, these rights will override our standard policies to the extent required by law. However, due to the high-value and fraud-sensitive nature of our Products, we reserve the right to verify all returns through identity checks and expert re-authentication before issuing any refund, in line with applicable consumer law.

10. VIDEO UNBOXING REQUIREMENT

10.1 Video Evidence

To be eligible for any refund or exchange under Section 9.2, you must video-record the unboxing of your shipment from the moment you open the tamper-proof packaging until you fully reveal the Product.

10.2 Reason for Requirement

This requirement helps protect both you and JWL against fraudulent or incorrect claims, given the high value of the Products and the ease of swapping or tampering with components.

10.3 Evaluation of Claims

If you submit a claim for a refund or replacement due to damage or receipt of the wrong Product, JWL will review a) the Dealer’s video of the boxing and tamper-proof sealing process; b) the certification documents and photographic evidence; and c) your submitted unboxing video.

All decisions regarding refunds or replacements are made on a case-by-case basis and at JWL’s sole discretion.

11. ID VERIFICATION AND COUNTER-FRAUD MEASURES

11.1 ID Verification

If you request a refund or if there is any suspicion of fraud, we may require you to provide a valid government-issued ID (e.g., passport, driver’s license) and any additional information necessary to confirm your identity.

11.2 Use of Information

Your personal data will be processed in accordance with our [Privacy Policy]. We will never sell or share your information with unauthorised third parties. However, we may share relevant information with law enforcement or regulatory bodies if required by law or as part of a fraud investigation.

12. LIMITATION OF LIABILITY AND DISCLAIMERS

12.1 Disclaimer of Warranties

All Products are provided on an “as is” basis. Although JWL works with reputable and certified Dealers, JWL makes no explicit or implied warranties regarding the authenticity, quality, or condition of the Products beyond what is stated in the listing or provided by the Dealer.

12.2 Limitation of Liability

To the maximum extent permitted by applicable law, JWL and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the Platform, purchase of Products, or these Terms.

12.3 Third-Party Actions

We are not liable for acts, omissions, or errors of third parties, including Dealers, shipping carriers, payment providers, or government authorities.

12.4 Local Legal Compliance

You are responsible for ensuring that your use of the Platform and your purchase and import of Products comply with all laws and regulations in your jurisdiction.

13. INTELLECTUAL PROPERTY

13.1 Platform Content

All text, graphics, logos, images, and other materials on the Platform (except for content provided by Dealers) are the property of JWL or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

13.2 Use of Platform Content

You may not use, reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written permission.

14. GOVERNING LAW AND DISPUTE RESOLUTION

14.1 Governing Law

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the jurisdiction in which JWL is registered, without regard to its conflict-of-law principles.

These Terms shall be governed by the laws of England and Wales.

14.2 Dispute Resolution

Any dispute arising under these Terms shall first be attempted to be resolved amicably. If such dispute cannot be resolved, it shall be subject to the exclusive jurisdiction of the courts of the governing law’s jurisdiction, unless otherwise required by mandatory consumer protection laws in your country of residence.

15. CHANGES TO THESE TERMS

We reserve the right to modify or update these Terms at any time to reflect changes in our practices, service offerings, or for legal and regulatory reasons. Your continued use of the Platform after any such update constitutes your acceptance of the revised Terms.
